Terms & Conditions
These Terms and Conditions govern the relationship between you, the participant, and us, Luxury Italian Tours. By booking a trip, you agree to be bound by these Terms and Conditions. They outline, among other things, our cancellation policy and certain limitations of liability. These terms affect your rights to sue, governing law, forum and jurisdiction; please be sure to carefully read these terms and make sure you understand your rights and obligations and our rights and obligations. Luxury Italian Tours, its and their employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, representatives, and assigns (collectively Luxury Italian Tours) does not own or operate any entity which provides, or is to provide, goods or services for your trip including, for example, lodging facilities, transportation companies, food service providers, equipment suppliers, etc. As a result, Luxury Italian Tours is not liable for any negligent or willful act or failure to act of any such third person, or of any other third party.
A deposit of 25% of the tour cost per person is required to secure your reservation. To secure reservations on a trip departing within 60 days, a full payment is required by credit card at the time of booking. Final payment for all trips must be made in full to LUXURY ITALIAN TOURS at least 60 days prior to departure. Reservations will be cancelled if final payment is not received by the due date and cancellation charges will apply (see below for cancellation terms). Tour prices stated are per person and based on double occupancy. For extra and/or incremental charge, those will be added to your invoice. Every effort has been made to produce pricing information accurately. We reserve the right to correct errors. Before the trip, a travel planner will be sent to the participant with all the information for preparing for the trip. Luxury Italian Tours strongly advices the Participants to read it carefully. Private Customized Trips Tour prices will be arranged individually based on the client’s specific requirements. If the trip planning process is approved and client makes extensive changes, including but not limited to changes to hotel booking and travel dates, additional planning fees may be incurred. Custom tours require payment of a non-refundable trip planning fee before commencement of tour planning activities, including, but not limited to securing hotel accommodations and tours. The trip planning fee will be applied to the cost of the custom trip. In the event that the trip is cancelled, the trip planning fee is not refundable.
Any additional activities requested on a small group tour that is arranged by Luxury Italian Tours, clients will be charged a 15% booking fee for additional services including daily tours, transportation and other services. Hotel bookings will be charged a 10% booking fee in addition to the hotel room charges. For more extensive requests, such as post-trips, pricing will be determined separately.
Luxury Italian Tours reserves the right to correct promotional or pricing errors at any time, or to increase the program price in the event of cost increases due to changes in currency fluctuations, entrance fee increases, taxes, or fuel surcharges. Luxury Italian Tours reserves the right to decline to accept or retain any person as a member of any tour or to cancel or alter the tour without notice, in which event your sole remedy shall be a prorated refund for any unused portion of the trip. Hotels and other accommodations are subject to change. Before starting a trip the Participant has to be covered by its insurance or any travel insurance he will previously apply for and will sign a release form for Luxury Italian Tours. The participants are voluntarily on a Luxury Italian Tours trip and have the knowledge of the numerous risks and dangers involved including but not limited to: negligence in the maintenance or operation of any van or other motor vehicle utilized to transport passengers, etc.; physical exertion for which the Participant is not prepared; forces of nature; transportation failures whether by plane, train, auto, boat, canoe, kayak, bicycle, ski, horseback or other animal, by foot, or by any other conveyance; consumption of alcoholic beverages; risks associated with food or impure water; civil unrest; terrorism or the threat thereof; criminal activity; dangers associated with wild or other animals; breakdown or failure of bicycles or other equipment; high altitude; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; epidemics or the threat thereof; and stolen, lost, or misplaced luggage or property. The participants have the acknowledge that the enjoyment and excitement of travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work and that these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. The participants agree to be responsible for their own welfare and accept any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma or death.
Luxury Italian Tours reserves the right to take photographic or film records of any of its trips and the participants agree that Luxury Italian Tours may use any such photographic or film records for promotional and/or commercial purposes, as well as approve such use by third parties with whom Luxury Italian Tours may engage in joint marketing, without any remuneration. By signing a release form, the Participants assign all right, title, and interest he may have in or to any and all media in which its name or likeness might be used by Luxury Italian Tours. Luxury Italian Tours reserves the right to make hotel, itinerary and trip modifications as required or desirable to improve the trip quality and/or to accommodate the comfort and well-being of guests. For this reason, there may be differences between the information on the website and Luxury Italian Tours cannot be held responsible for it. .
You must advise us in writing, at or prior to booking, of any physical, emotional or mental condition which may require professional attention during the trip or may require the use of special equipment. If you fail to disclose any such conditions, Luxury Italian Tours may refuse to allow you to take the trip and you will (be subject to the cancellation charges as referenced below ) forfeit the trip cost; and in such event we shall have no liability, financial or otherwise.
If you are so challenged, you must bring and be responsible for all necessary items related to your condition. If any such condition arises after the trip is booked, you must advise us in writing immediately. Failure to advise us shall release Luxury Italian Tours and all professional personnel from any liability related to such condition or its treatment.
We cannot accommodate women past their sixth month of pregnancy. We also cannot accommodate passengers requiring wheelchair assistance, as most features of Luxury Italian Tours trips are not wheelchair-accessible.
Children six (6) years or older are welcome on our group tours if accompanied by an adult.
Health & Fitness
We will send you information on the physical requirements for your trip with your pre-trip materials. In some cases, you may want to discuss these with your doctor. Your health and safety during your trip are our first concern, but Luxury Italian Tours is not a medical facility. You should be in good health to participate in our vacations. Luxury Italian Tours reserves the right to decline any trip participant whose condition, in our opinion, may affect the health, safety or enjoyment of other participants. Luxury Italian Tours is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is Luxury Italian Tours responsible for the quality of medical care, or lack thereof, you may receive while on the trip. We strongly recommend that you obtain medical and dental insurance that will cover the cost of any medical and dental assistance you may require during your trip.
This relationship shall be governed by the laws of New York. Any claims against Luxury Italian Tours must be brought in the County of New York, State of New York.
Most programs offer a limited number of single rooms, subject to availability and hotel space. Please see the specific single supplements that apply for each tour.
All Luxury Italian Tours trips and their extensions are limited to no more than fourteen (14) participants (with the exception of our tours in Sicily, which can accommodate up to sixteen (16) participants). Custom trips are excluded from group size requirements. All trips and trip extensions require a minimum number of participants to operate. Luxury Italian Tours reserves the right to change the departure date of any trip, as well as cancel any trip or optional extension that does not reach a minimum level of participation. Should this occur, clients will be 100% reimbursed for any payments received.
All international programs require a valid passport. All information on your passport including name, passport number and expiration date are needed at time of booking. Luxury Italian Tours is not responsible in any way for your failure to do so
Tour price includes all lodging, meals and activities that are specified for each tour. Gratuities for hotels and the food portion of your tour are paid by Luxury Italian Tours; gratuities for alcoholic drink servers are not. Gratuities for Luxury Italian Tours leaders are always appreciated but are entirely at your discretion.
Tour prices are based on double occupancy rooms. Solo travelers will be assigned a roommate of the same gender, if requested. Single rooms are available on a limited basis with a single supplement fee. We may not be able to honor private room requests during certain peak periods. For late bookings (less than 60 days prior to departure), solo travelers will be charged a single supplement fee that will be refunded if a roommate is later assigned. Single rooms are often smaller than double rooms. Although rooms typically vary in size, layout and style, private baths are guaranteed every night in Europe. On all other tours where there is a mix of baths, private baths are assigned as evenly as possible.
The Luxury Italian Tours web site and associated electronic publications are owned and operated by Luxury Italian Tours. Except where otherwise specified the contents of this Web site are subject to intellectual property rights including copyrights and trademarks held by Luxury Italian Tours, all rights are reserved. The content of this Web site is provided for informational purposes only and may include inaccuracies, typographical errors, or change periodically. All materials are provided as is where is unless explicitly stated.
Exceptions to this policy cannot be made for any reason, including, but not limited to, weather, terrorism, civil unrest, personal, family or medical emergencies. The Participant understands that this is a legally binding and enforceable contract and accepts it of its own free will. The Participant agrees that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
Cancellation Policy - Cancellation by Client on Group Tours
If it becomes necessary to cancel your trip, please contact Luxury Italian Tours Inc. in writing. The following schedule applies and is determined by the day that we receive written notification:
Cancellation Policy - For Private Trips, not Part of Small Group Tours
Any confirmed reservations are subject to the cancellation policy set forth by third party vendors engaged by Luxury Italian Tours on behalf of the party. Luxury Italian Tours cannot provide any additional compensation beyond their policies. Luxury Italian Tours will bill accordingly for completed work at the time of the cancellation.
Cancellation Policy - Cancellation by Luxury Italian Tours
Luxury Italian Tours reserves the right to cancel a (group) tour, in cases where the necessary minimum number of participants, as is specified on the website, has not been reached. Participants will be notified of any such cancellation in writing at least 60 days prior to departure. Replacement.
If you cannot travel as planned, you have the right to send someone in your place, provided that Luxury Italian Tours is notified within seven (7) days of the departure date. Luxury Italian Tours can object to the above replacement if the replacement does not satisfy the requirements for participants. In such case the cancellation conditions will apply.
The original contract is not affected by replacement, but any resulting additional costs due to this replacement will be charged to the client. Luxury Italian Tours is not responsible for any possible non-acceptance of the above replacement by any other organizers or agents involved with the tour.
Luxury Italian Tours reserves the right to update pricing if the U.S. Dollar depreciates against the Euro by more than 10% from December 31, 2015 to the start of the tour.
